Citizen Games is designed so that showing up without your own equipment is never a barrier. All rentals are inspected, cleaned, and RSO-approved before the event. First-time renters receive a mandatory 10-minute safety and handling orientation at check-in.

Liability Waiver, Release & Assumption of Risk

⚠ NOTICE TO PARTICIPANT — READ CAREFULLY BEFORE SIGNING

1. PARTIES. This Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement ("Agreement") is entered into by the undersigned participant ("Participant") in favor of Citizen Games LLC, its owners, officers, directors, employees, contractors, volunteers, Range Safety Officers (RSOs), sponsors, partner organizations, landowners, and any other persons or entities involved in organizing or conducting Citizen Games events (collectively, "Released Parties").

2. NATURE OF ACTIVITY. Citizen Games events combine competitive shooting with physical fitness challenges ("Tactical Fitness Competition"). Activities include but are not limited to: running, carrying weighted loads, crawling, climbing, jumping, functional fitness movements, and the handling, loading, and discharge of live firearms including pistols and semi-automatic rifles (AR-15 platform) at targets on a live-fire range. These activities are conducted simultaneously and in combination.

3. ENUMERATION OF INHERENT RISKS. Participant expressly acknowledges the following specific, foreseeable inherent risks associated with participation, which exist regardless of the care taken by Released Parties:

(a) Ballistic risks: gunshot wounds from accidental discharge (own or another participant's firearm); ricochets; fragmentation; squib loads; hang fires; firearm malfunctions; round-over-round conditions;
(b) Physical injury from fitness stages: muscle strains, tears, and ruptures; fractures; dislocations; spinal injuries; cardiovascular events including heart attack and stroke; heat exhaustion and heat stroke; dehydration; exertional rhabdomyolysis; falls on uneven terrain;
(c) Environmental and equipment risks: hearing damage from firearm discharge; lead, copper, and carbon monoxide exposure; eye injury from ejected brass or debris; equipment failure including holster, belt, or vest malfunction; tripping or collision hazards on active range;
(d) Third-party risks: injury caused by the negligent or reckless acts of other participants; injury caused by animals, insects, or weather conditions at outdoor venues;
(e) Rental equipment risks: Participant who selects rented firearms, ammunition, battle belts, or weighted vests acknowledges that (i) rental equipment may have mechanical wear not visible upon inspection; (ii) Participant accepts the equipment as inspected at check-in; and (iii) Participant is responsible for immediately notifying the RSO of any equipment concern before use. Failure to report a concern and continuing to use the equipment constitutes acceptance of any associated risk;
(f) Psychological and emotional injury arising from the stress of competitive performance, exposure to firearm discharge, or witnessing injury to another person.
THIS LIST IS NOT EXHAUSTIVE. Additional risks not specifically identified may exist.

4. EXPRESS ASSUMPTION OF RISK. Participant expressly and voluntarily assumes all risks of injury, death, property damage, or other loss arising from or related to participation in Citizen Games events, whether such risks are inherent in the activity, caused by the ordinary negligence of Released Parties, or otherwise foreseeable. Participant acknowledges that no amount of instruction, supervision, or safety precaution can eliminate all risks associated with live-fire tactical fitness competitions.

5. RELEASE OF LIABILITY. In consideration of being permitted to participate, Participant hereby releases, waives, discharges, and covenants not to sue Released Parties from any and all liability, claims, demands, causes of action, and damages of any nature whatsoever arising out of or related to participation, to the maximum extent permitted by applicable law. Pursuant to Minnesota Statutes § 604.055, this release applies to claims arising from ordinary negligence only and does not purport to release liability for conduct constituting greater than ordinary negligence, gross negligence, willful, wanton, or intentional misconduct.

6. INDEMNIFICATION AND HOLD HARMLESS. Participant agrees to indemnify, defend, and hold harmless Released Parties from and against any and all claims, demands, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Participant's participation in any Citizen Games event; (b) any breach by Participant of this Agreement; (c) Participant's violation of any range safety rule or RSO command; (d) any injury or damage caused by Participant to any third party; or (e) Participant's use of rented or personal equipment. This indemnification obligation survives the termination of this Agreement.

7. RSO AUTHORITY AND COMPLIANCE COVENANT. Participant acknowledges and agrees that: (a) all Range Safety Officers hold binding authority over all range and fitness-stage activities during the event; (b) RSO commands — including but not limited to LOAD, MAKE READY, FIRE, CEASE FIRE, UNLOAD, and MAKE SAFE — are mandatory and must be obeyed immediately without question; (c) any failure or refusal to comply with an RSO command is a safety violation; (d) Citizen Games reserves the right to immediately disqualify, remove, and permanently ban any Participant who violates range safety rules, regardless of competitive standing, without refund of any fees or add-on costs; and (e) Released Parties are not liable for any injury arising from a Participant's failure to comply with RSO commands or range safety rules.

8. HEALTH AND FITNESS REPRESENTATION. Participant represents and warrants that: (a) Participant is in adequate physical condition to participate in the competitive tier selected; (b) Participant has disclosed all known medical conditions, injuries, and limitations in the registration form; (c) Participant has consulted with a physician if there is any doubt about their capacity to safely participate; and (d) Participant accepts sole responsibility for any injury or adverse health event arising from an undisclosed or unknown medical condition. Released Parties are not responsible for performing medical screening of Participants.

9. EMERGENCY MEDICAL AUTHORIZATION. In the event Participant is unable to communicate due to injury, illness, or incapacitation, Participant authorizes Released Parties and emergency medical personnel to take all reasonable steps to obtain emergency medical treatment, including transportation to a medical facility, on Participant's behalf. Participant understands that costs of such treatment are solely Participant's responsibility. Released Parties shall have no liability for any medical treatment decisions made in good faith under emergency conditions.

10. PROPERTY DAMAGE. Participant assumes full responsibility for any damage to or loss of Participant's own personal property, firearms, equipment, or vehicle arising from participation in any Citizen Games event. Released Parties are not responsible for the safekeeping of personal property left unattended at the event venue.

11. MEDIA AND LIKENESS RELEASE. Participant grants Released Parties a perpetual, royalty-free license to photograph, record, and use Participant's name, image, voice, and likeness in connection with the promotion, marketing, and documentation of Citizen Games events in any media, including social media, without additional compensation. Participant may opt out by notifying Citizen Games in writing before the event.

12. FIREARMS LEGAL COMPLIANCE. Participant represents that: (a) Participant is legally permitted under federal, state, and local law to possess, handle, and discharge the firearm(s) used during the event; (b) any personally owned firearm brought to the event is legally owned and registered where required; and (c) Participant is not prohibited from possessing firearms under 18 U.S.C. § 922(g) or any applicable state law. Any misrepresentation of legal status constitutes a material breach of this Agreement and may result in immediate removal and referral to law enforcement.

13. DISPUTE RESOLUTION. The parties agree to attempt resolution of any dispute arising under this Agreement through good-faith negotiation, then non-binding mediation, before initiating any legal proceeding. Any legal action shall be brought exclusively in the state or federal courts located in Kandiyohi County, Minnesota.

14. GOVERNING LAW. This Agreement shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflicts-of-law principles. Any provision found void or unenforceable under Minnesota law, including pursuant to Minnesota Statutes § 604.055, shall be severed from this Agreement; all remaining provisions shall continue in full force and effect.

15. ENTIRE AGREEMENT / VOLUNTARY EXECUTION. This Agreement constitutes the entire agreement between Participant and Released Parties with respect to the subject matter hereof. Participant affirms that: (a) this Agreement has been read carefully and completely; (b) all terms are fully understood; (c) no representation, promise, or inducement not set forth herein has been made; (d) this Agreement is executed freely and voluntarily, without duress or coercion; and (e) Participant had the opportunity to consult with legal counsel prior to executing this Agreement.
